Myth vs. Fact: The SAVE America Act

Get the facts about what the SAVE America Act actually does — and what it doesn't.

Myth: Only citizens can vote — so this law isn't necessary
Fact:

Only U.S. citizens can legally vote in federal elections—but current law makes it difficult for states to verify citizenship during voter registration.

As a result, the requirement is not consistently enforced, and there have been documented cases of non-citizens voting.

Myth: It disenfranchises women who change their names
Fact:

The SAVE America Act includes a process for individuals who change their name—such as after marriage—to register and vote, including the option to sign an affidavit at the polls.

These situations are expected to be rare, and would only apply in limited cases where voter registration records have not been updated in a short time window.

Myth: It prevents deployed military members from voting
Fact:

The bill does not change existing protections for military voters.

Service members voting abroad can continue to register and vote under current law without disruption.

Myth: You need a U.S. passport to register to vote
Fact:

A passport is just one option. The SAVE America Act allows multiple ways to verify citizenship, including:

  • U.S. passport
  • Military ID + service record showing U.S. birthplace
  • Government-issued ID showing U.S. birthplace
  • Government-issued ID + additional supporting documents

This ensures flexibility while still verifying citizenship.

Myth: It requires proof of citizenship when casting a ballot
Fact:

That is not current law in the bill.

Citizenship is verified during voter registration, not at the polling place. When voting, only a standard photo ID is required.

Myth: The SAVE America Act is unconstitutional
Fact:

The Constitution gives Congress authority over federal elections.

This includes powers under the Elections Clause, Naturalization Clause, and multiple constitutional amendments—providing a clear legal basis for the legislation.
